How Do You Get a Lien Removed From Your Property So You Can Sell Your Land

If you’re trying to sell your land in North Florida but your property has a lien against it, your real estate agent will most likely tell you it’s a good idea to get the lien removed.

So where do you start?

How Do You Get a Lien Removed From Your Property So You Can Sell Your Land?

A lien against your property will hold you back from selling it until the debt is paid. The easiest – and probably fastest – way to remove a lien from your property is to pay the debt the creditor says you owe (as long as it’s valid).

However, follow all these steps to make sure the lien is fully removed from your property’s title so you can sell it free-and-clear:

  1. Make sure the debt is valid. If you don’t think you owe the debt, you might want to talk to a lawyer. You can also ask the lien holder – the organization that put the lien against your property in the first place – to provide proof of your debt.
  2. Pay off the debt. If it’s valid, pay your creditor in full. Sometimes creditors are willing to negotiate, so see if the company has any leeway if you’re willing to pay off what you owe.
  3. Fill out a release-of-lien. Your attorney can provide you with this document – and if you don’t have an attorney, talk to the county clerk. They can point you in the right direction.
  4. Have the lien holder sign the form in front of a notary. This document must be notarized for it to be valid in the vast majority of cases.
  5. File the lien release. Head to the county recorder’s office to file the lien release form. The recorder can let you know how much it costs to file (in some places, it’s free; in most, there’s a small fee involved).
  6. Keep a copy. Don’t forget to hang on to your own copy of the notarized lien release form in case you need it in the future.
